EGR cooler and emissions in Volkswagens - could this be true?

A few months back I had to replace EGR cooler in my Touran at 38000 miles. Volkswagen agreed to pay for parts but not labour despite me querying this with them. I know now my car is one of those affected by Volkswagen emmissions problem. Could this have been a contributing factor to my egr cooler issue?

If it's an EA189 1.6 TDI then these are notorious for EGR problems.
