Is there a way to check if my dealership did the emissions fix without my consent?

Is there a definitive test that can be carried out to determine whether or not my dealership has carried out the software fix without my consent? My 2010 Volkswagen Golf 1.6 TDI is due for its MoT in May. Is there an emissions figure that would confirm update had been carried out? I'm suspicious and losing trust with the dealership. The EGR failed 4000 miles after last service. it's only done 52,000 miles in total. Dealership carried out a software update during service but said it was for other issues.

No check-list. They may be under orders to do it so, if you don't want it done, you have to issue specific written instructions that you do not want it done, holding the dealer liable for any post fix problems if he does it against your will and problems occur.
