Parking Ticket - can I fight it?

I parked my car in a private car park in Barnet, the Spires Shopping Centre in January, paid for my ticket. After taking my disabled son to the dentist, I returned to the car park and went home. When the disabled spaces are in use, I pay for a normal bay. However I received a letter from The Legion Group saying I have an outstanding fine and if I don't pay it, they will take me to court.

I said that I never received a parking notice and this is the first time of hearing this, I questioned it and they emailed me with photographic evidence to show that I had parked my car. I never denied that I parked my car, and my ticket is displayed in the window.

As I never received a parking fine or the reasons why, I now have received a Debt Recovery Plus letter with the heading "Reduced Payment Offer £130" - this is madness and I have phoned the woman from Debt Recovery Plus to say that I have never received a parking ticket let alone any correspondence from The Legion Group.

The letter states it will be handed over to solicitors and I will get a CCJ with more and more costs added onto the £130 which will escalate to £200 plus. Please can you inform me of what I should do, as a single mother to a disabled child, I already am finding it hard, let alone having the stress of this whole mess.

Debt Recovery Plus Ltd, don't care, and all they say it that I parked my car and the photo proved it. Were I to have gotten a fine, I would have dealt with it there and then. However I never received any correspondence from anyone let alone the Legion Group.

You take this matter to the small claims track of the County Court using www.moneyclaim.gov.uk, counterclaiming for criminal fraud and harassment. They have absolutely no right at all to threaten you in this intimidating manner and may well face prosecution and a heavy fine themselves. See: www.honestjohn.co.uk/faq/private-parking-penalties/
